Terms of Service

These Terms govern your access to and use of bottlesmart.sbs (the “Site”) and any related services. If you do not agree, do not use the Site.
1) Eligibility, accounts, and security
- You must be legally able to enter a contract where you live.
- If you create an account, you are responsible for activity under your credentials and for keeping login details secure.
2) Orders, pricing, and disclosures
If the Site presents products for mail order sale, required transaction and provider information (including price, shipping, payment timing/method, delivery timing, and cancellation/returns) will be displayed on the relevant product/checkout screens and/or the “Business Information” area, consistent with the Act on Specified Commercial Transactions (Act No. 57 of June 4, 1976), Article 11, and the checkout screen requirements for specified offers under Act on Specified Commercial Transactions (Act No. 57 of June 4, 1976), Article 12-6.
You must review all order details before submitting an order. We do not permit misleading practices; marketing and on-page representations must not be materially false or misleading under Act on Specified Commercial Transactions (Act No. 57 of June 4, 1976), Article 12 and Act against Unjustifiable Premiums and Misleading Representations (Act No. 134 of 1962.
3) Product safety and user responsibilities
- Always supervise infants and children around heated liquids and devices.
- Manually verify bottle temperature before feeding (e.g., shake and test a few drops on your wrist). Do not rely solely on any temperature reading, app display, or AI assist.
- Use only as instructed and stop use if you observe damage, abnormal heating, or unsafe conditions.
- Where applicable, electrical-safety compliance and required labeling will be handled and described in accordance with the Electrical Appliance and Material Safety Act (Act No. 234 of 1961). Do not assume any compliance mark unless explicitly stated on the product/packaging.
4) AI assist and no medical advice
Any AI-driven suggestions, presets, or guidance (if offered) are provided for general informational purposes only and are not medical advice, diagnosis, or treatment. Consult qualified professionals for health concerns. You remain responsible for confirming suitability and safety for your use case.
5) Acceptable use
- Do not misuse the Site (e.g., interfere with security, scrape at scale, introduce malware, or attempt unauthorized access).
- Do not submit unlawful, infringing, or deceptive content.
6) Intellectual property
The Site, content, and trademarks are owned by or licensed to us and are protected by applicable laws. You may not copy, modify, distribute, or create derivative works except as permitted by law or by our written permission.
7) Privacy, cookies, and external transmissions
We handle personal information in line with our Privacy Policy and the Act on the Protection of Personal Information (Act No. 57 of 2003). Device identifiers/cookies and related information may be treated as “personally related information” under PPC guidance; disclosures and any required steps for third-party sharing are addressed under the Act on the Protection of Personal Information (Act No. 57 of 2003).
If our use of tags/SDKs results in external transmission of user-related information to third parties, we will provide readily accessible disclosures consistent with the Telecommunications Business Act (Act No. 86 of 1984), Article 27-12. See: External Transmission Disclosure and Privacy Policy.
8) Marketing communications
If you opt in to marketing emails, we will provide an unsubscribe method and honor refusal requests in accordance with the Act on Regulation of Transmission of Specified Electronic Mail (Act No. 26 of 2002).
9) Disclaimers and limitation of liability
The Site and services are provided on an “as is” and “as available” basis to the extent permitted by law. We do not exclude liability where exclusion is not permitted by applicable law. To the maximum extent permitted, we are not liable for indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site.
10) Changes
We may update these Terms from time to time. The “Effective date” above indicates the latest revision. Material changes will be posted on the Site.
11) Governing law and venue
These Terms are governed by the laws of Japan. The Tokyo District Court will have exclusive jurisdiction in the first instance for disputes arising out of or relating to these Terms or the Site, unless mandatory law provides otherwise.
